GENERAL INFORMATION

The general conditions define the conditions of sale of the Agency and the customer. AMMIVILLAS is a local travel agency specialized in renting villas with swimming pools, which provides and ensures the highest possible quality of service to its guests. All the villas on the agency’s website are under contract with AMMIVILLAS and have all the necessary documentation issued by the competent state authorities.

INTRODUCTION
The rental agreement that you enter into with the AMMIVILLAS agency as an intermediary, you enter into as a lessee (hereinafter: guest) with the owner of the holiday villa (hereinafter: villa) as a lessor (hereinafter: owner). AMMIVILLAS acts exclusively as an intermediary and can only be held responsible in this sense.
By making an advance payment for the reservation of the selected villa at the desired date, you unconditionally agree to these General Terms and Conditions, which are published on the website of AMMIVILLAS: www.ammivillas.com and come into force on the day of publication.
After AMMIVILLAS receives the payment of the reservation, the guest will be sent a written confirmation of the reservation (hereinafter: confirmation) with all the necessary data and information. The written confirmation of the reservation together with these General Terms and Conditions constitutes a rental agreement between the guest as lessee and the owner as lessor.

ARRIVAL AND DEPARTURE
The earliest arrival is at 4 pm on the day of arrival. Check-out no later than 10:00 a.m. on the day of departure. Early arrival and late departure will not be possible.
Guest registration
According to the laws of the Republic of Croatia, the guest is obliged to hand over official identification documents with personal data to the landlord/host of the villa for the purposes of tourist registration at the Tourist Board (HTZ). This data will not be used for any other purpose. A guest who does not present the identity card required by law for tourist registration may be denied access to the accommodation without the possibility of refunding the rent paid.


VILLA
Number of guests
At no time may there be more people in the facility than stated on the reservation confirmation. It is possible to increase the number of guests up to the maximum capacity specified on the villa’s website, with a notice at least 3 (three) days before arrival. The desired change in the number of guests must be requested in writing by e-mail. The maximum number of guests also applies to children, regardless of age.
If more guests stay in the villa or its property than announced, the owner and/or AMMIVILLAS reserve the right to terminate the rental agreement without prior notice, with immediate effect. Guests will then permanently leave the villa within 2 (two) hours. Refunds for unused rental periods will not be possible.

Groups of younger guests
Guests who are 25 years old or younger are considered a younger group of guests. Special conditions may apply to such groups, depending on the rules of the owner of each villa. AMMIVILLAS must be informed about the age of the group in advance or immediately after booking.
Failure to comply with this article may result in the immediate cancellation of the reservation, in which case guests will not be entitled to a refund of the payment made. Tents, caravans, etc. may not be parked in or near the villa. If this prohibition is not respected, the owner or AMMIVILLAS have the right to terminate the rental agreement without prior notice with immediate effect. After that, the guest will permanently leave the villa together with all the persons staying in it within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or AMMIVILLAS.
If the guest notices that campers, tents, trailers, etc. are parked in the specified prohibited places, he is obliged to inform the owner of the villa or the AMMIVILLAS agency.

Pets and allergies
Whether visits with pets are allowed and under what conditions will be stated on the website of each individual villa. Pets are strictly prohibited from entering the swimming pools. Any additional cleaning charges due to pets are listed on each villa’s website. When making a reservation, the guest will specify the number of pets. A pet cleaning surcharge (where applicable) will automatically be added to the rental price. The number of pets in the villa must not exceed the registered number stated on the certificate. If the guest wants to bring more than 2 (two) pets, they will contact AMMIVILLAS separately. No more than 2 (two) pets can be accommodated in one villa without written consent.
Dog owners are responsible for cleaning up after their pets. Pets must not climb on the furniture at any time. Any evidence of animals on the furniture may lead to an increase in final cleaning costs. All pets must be timely vaccinated against rabies and all other diseases in accordance with current regulations. Guests are advised to familiarize themselves with the possible diseases of pets in the travel zone and to prevent them. The guest is solely responsible for keeping pets in the villas. The owner and AMMIVILLAS do not assume responsibility for any illnesses or injuries of pets during the stay.
Pets are not allowed in some villas. However, neither the owner nor AMMIVILLAS can guarantee that pets have not previously lived in the house or that the owner does not keep pets. AMMIVILLAS assumes no responsibility for allergic reactions of guests that may occur in any holiday home. In case the guest brings an unannounced pet, the owner and/or AMMIVILLAS reserve the right to cancel the rental agreement without prior notice with immediate effect. After that, the guest will permanently leave the villa together with all the persons staying in it within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or AMMIVILLASA.
Noise
If guests disturb public order and peace with noise and do not calm down even after a warning, this can be interpreted as a serious violation of the provisions of the rental agreement, whereby the owner and/or AMMIVILLAS can immediately terminate the rental agreement without notice. After that, the guest will permanently leave the villa together with all the persons staying in it within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or AMMIVILLAS.
Swimming pools
The guest is obliged to follow all instructions regarding the use of the pool (if available in the villa) given by either the owner or AMMIVILLAS for their own safety. The guest uses the pool at his own risk and is responsible for the events at the pool in all respects. Children must not be near the pool or in the pool without adult supervision. If the villa is booked outside the summer season, it could happen that the pool is not working.
The guest uses the Jacuzzi (if available in the villa) at their own risk and should be aware of certain health risks associated with the use of the Jacuzzi. The water in the Jacuzzi may not be warm until late in the evening on the day of the guest’s arrival. Standing on Jacuzzi covers and pool covers is prohibited, as they are not designed to support a person’s weight and can easily break. If the cover breaks, the guest is obliged to compensate the damage directly to the owner.


HOUSE RULES
There is a special house rule for each villa, which is displayed in a visible place in the villa. Guests are obliged to follow the house rules. Non-observance of the house rules can be interpreted as a serious violation of the provisions of the rental agreement, whereby the owner and/or AMMIVILLAS can immediately terminate the rental agreement with the guest without a notice period. After that, the guest will permanently leave the villa together with all the persons staying in it within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or AMMIVILLAS.


PRICES AND METHOD OF PAYMENT
Unless otherwise indicated, all prices are in euros per villa per week. Card payment is made in euros. The reservation is binding, and during the reservation process it is necessary to pay an advance payment of 30% of the agreed rental price, with which you confirm the reservation and enter into a contract with the owner and accept these General Terms and Conditions, which are an integral part of the rental agreement. After the reservation process has been completed and the payment has been made, AMMIVILLAS will send a written confirmation of the reservation by e-mail, which will contain all the necessary information about the accommodation and together with these General Terms and Conditions will constitute the rental of the villa. The contract concluded with the owner through AMMIVILLAS is considered concluded as soon as AMMIVILLAS receives the reservation payment. In the event that the payment is not made within 3 (three) days from the day of the reservation, the Rental Agreement is considered terminated. The costs of water, gas and electricity consumption, internet access, bed linen, kitchen towels, final interior cleaning, pool and exterior maintenance, registration and residence tax and sales tax are included in the rental price.
The following payment methods are accepted for advance payment: credit cards and bank transfer. All payments are made in euros (EUR). Accordingly, there is a possibility of exchange rate differences. AMMIVILLAS is not responsible for exchange rate differences and fees of other banks.
For the payment of the rest (70% of the agreed rental price), all payment options are valid, as well as for advance payments. When paying by credit card and bank transfer, the payment must be made no later than 30 days before arrival at the villa, in order for AMMIVILLAS to remit the received payment to the owner. If you want to cancel the payment, please contact us in writing to the e-mail: info@ammivillas.com and explain the reasons for cancellation.
For cancellations up to (including) 60 days before the planned arrival, the total amount paid will be refunded.
For cancellations up to (including) 30 days before the planned arrival, 30% of the total amount paid will be refunded. For cancellations up to (including) 29 days before the planned arrival, the amount paid will not be refunded.

Reservations 30 days or earlier before the rental
For reservations made 30 days or earlier before the start of the rental, the following conditions apply:
An advance payment in the amount of 30% of the total contracted rental price is due immediately if a credit card is chosen as the payment method. If the guest decides to make a bank transfer, the advance payment must be received in AMMIVILLAS within 3 (three) days;
The rest of 70% of the contracted rental price is due no later than 30 (thirty) days before the start of the rental, provided that payment is made by credit card or bank transfer. If cash payment is selected (for villas where this option is accepted, which will be specified during the booking process), the remaining 70% of the rent is due immediately upon the guest’s arrival, allowing the guest to pay the appropriate amount directly to the owner/host. Cashless payment is not possible in the villas.

Reservations 30 days or less before rental
The full rental amount is due IMMEDIATELY when paying by credit card or bank transfer. Bank transfer cannot be selected as a payment option if there are less than 15 days left between the day of reservation and the day of arrival.
If the guest decides to pay part of the agreed rental price in cash (for villas in which this option is accepted, which is indicated at the time of reservation), an advance payment in the amount of 30% of the full rental price is due IMMEDIATELY, while the remaining 70% is paid upon the guest’s arrival . Cashless payment is not possible in the villas.
Non-compliance with payment deadlines
The guest undertakes to make the payment within the terms defined in this point of the General Conditions and in the manner explained here. If the guest does not comply with the payment terms, this will be interpreted as a serious breach of contractual obligations, which means that the rental agreement is considered terminated without a notice period. In case of termination of the rental agreement, the amounts paid to AMMIVILLAS will not be returned.
All payments will be made in Croatian currency. The amount for which your credit card account will be charged is obtained by converting the price in euros to Croatian kunas according to the current exchange rate of the Croatian National Bank. During a credit card top-up, the same amount is converted to your local currency at the exchange rate of the credit card association. As a result of this conversion there is a possibility of a slight difference compared to the original price listed on our website.
A.M. Immobilien Company d.o.o. uses WSPay for online payments. WSPay is a secure system for online payments, real-time payments, credit and debit cards and other payment methods. WSPay provides customers and merchants with secure entry and transfer of entered card data, which is confirmed by the PCI DSS certificate that WSPay has. WSPay uses an SSL certificate with 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection when entering and transferring data.

TERMINATION AND CHANGES TO THE AGREEMENT
The concluded rental agreement can only be terminated in writing (by e-mail). Termination takes effect from the date of receipt by AMMIVILLAS and only under the conditions specified in this point. If the guest succeeds in finding another guest who can use the villa in his place at the same time, at the same price and under the same conditions, AMMIVILLAS will immediately, after receiving all the necessary information about the new guest in writing, transfer the rental agreement to the new guest and send a written confirmation of this. AMMIVILLAS retains the already paid partial amounts of the rental price according to the transferred contract, while the new guest is obliged to pay the remaining amount up to the full rental price, depending on the previously selected payment method that is an integral part of the contract.
It is not possible to transfer the reservation to another villa because AMMIVILLAS forwards all payments to the respective villa owners without delay.
If the concluded lease agreement cannot be fulfilled or if the fulfillment of the agreement is significantly hindered by force majeure (e.g. war, natural disasters, environmental disasters, epidemic, border closure, strike, etc.), which could not be foreseen at the time of the conclusion of the agreement , AMMIVILLAS and the owner can terminate the rental agreement, because neither AMMIVILLAS nor the owner can be responsible for the occurrence of the aforementioned circumstances.

RENTAL SECURITY IN THE VILLA AND DAMAGE COMMITTED BY GUESTS
The amount of the rental deposit that the guest pays to the owner/host upon arrival will be specified in the written confirmation of the reservation. The security deposit serves the owner as insurance against damage to the villa. If the damage is greater than the specified deposit, the guest will compensate the owner for the full amount of the damage. If there is no damage to the villa, the owner will return the deposit upon the guest’s departure.
The guest undertakes to use the rented villa responsibly. The guest is obliged to hand over the villa in the condition in which he found it. The guest is directly responsible to the owner for the damage caused. If the rental deposit does not provide enough funds to cover the damage, the guest will pay the difference directly to the owner/host up to the full amount of the damage.
Deliberate damage to property and disturbance of public order will be considered a serious violation of the terms of the rental agreement, which means that the owner and/or AMMIVILLAS may terminate the rental agreement without notice and with immediate effect. After that, the guest will permanently leave the villa together with all the persons staying in it within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or AMMIVILLAS.
The guest will immediately notify the owner of damage to the villa and property around the villa during the rental period. Before the guest leaves and hands over the keys, the guest will inspect the villa and the property around the villa together with the owner/host. If no damage has occurred, the owner/host will return the rental deposit to the guest in accordance with these Terms and Conditions – if paid by the guest.
Additional cleaning effort due to particularly poor condition of the villa after the guest has returned it to the owner/host may also be considered as damage, so the owner/host must pay for such damage from the rental deposit.

EXISTING FAILURES AND COMPLAINTS
If, when taking over the villa, the guest notices inadequate cleaning, damage and other defects in the villa or has any other objections, they will complain immediately, and in any case within 24 hours. Complaints about inadequate cleaning must be reported immediately. Complaints are submitted directly to the owner of the villa or his authorized representative.
The guest is obliged to the maximum extent possible to prevent or limit the occurrence of damage and help to keep any kind of loss for the owner as small as possible.
In case of any kind of complaint, the guest will set a reasonable deadline for the owner to remedy the defect. Leaving the villa before the end of the agreed rental period and without prior notice and consultation with AMMIVILLAS is at the guest’s risk and expense, whereby AMMIVILLAS assumes no responsibility.
The owner of the villa is responsible for deviations from the condition of the villa specified on the AMMIVILLAS website.

AMMIVILLAS AS MEDIATOR
AMMIVILLAS is a tourist agency that acts as an intermediary in the rental of villas on the basis of the agreement on mediation in the provision of accommodation services concluded with the owners of the villas. AMMIVILLAS is not the owner of the villas. The owner, in the contracts concluded with AMMIVILLAS, has undertaken to provide accurate and complete information about his villa, so that he bears full responsibility towards the guest. If, contrary to the expectations of AMMIVILLAS, the reservation cannot be made due to circumstances beyond the control of AMMIVILLAS, e.g. as a result of judicial sale or gross breach of contract by the owner, etc. AMMIVILLAS can cancel the reservation and payment already made by the guest and immediately return the agreed amount.


GENERAL PROVISIONS AND JURISDICTION
AMMIVILLAS transfers all information about the villas to its website and tries to offer the most accurate and up-to-date information it receives from the owners of the villas. Owners are solely responsible for providing accurate and complete information about villas, therefore AMMIVILLAS cannot be held responsible for incorrect, incomplete or incorrect information.
Any use of data published on www.ammivillas.com for commercial purposes, including any form of partial or complete reproduction, constitutes a violation of copyright and is prohibited by law. In case of violation of the provisions of this Rental Agreement, the Owner (in agreement with AMMIVILLAS) and/or AMMIVILLAS may terminate the Rental Agreement without notice with immediate effect. After that, the guest will permanently leave the villa together with all the persons staying in it within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or AMMIVILLAS. The contracting parties will resolve any disputes by agreement and peacefully. The contracting parties will try to resolve any possible disputes by agreement and agreement. In case of any dispute, the local jurisdiction of the competent court in Puli and the application of Croatian law. These General Business Terms and Conditions have been drawn up in Croatian and have been translated into English and German by an authorized court interpreter. In case of doubt regarding the interpretation of certain terms in the translated version of these General Conditions, the original version in the Croatian language is taken as authoritative.
